November Reflections on Gratitude

T

his month, out of the gate, I’d like to recognize all the Veterans who have served our country. On behalf of AAOC, I sincerely thank you for your dedicated service and the sacrifices that both you and your families have made in order to preserve our nation and way of life. While not specifically connected to AAOC business, my experience has taught me that small gestures such as personally thanking veterans for their service can be incredibly meaningful. So, in the spirit of the Thanksgiving season, I spent some time reflecting on who and what I am thankful for. As it relates to my roles as a rental housing provider and as president of AAOC: Firstly, I would like to take a moment to thank Denise Cato, executive director of the Fair Housing Council of Orange County, for her excellent seminar “Fair Housing Starts with You!” Each time I have taken one of Denise’s courses over the last two decades, I have been pleased to learn something

new and insightful. Additionally, my appreciation of the equally long relationship between AAOC and the Fair Housing Council continues to grow as I am also reminded of how important their collaboration is in serving our members and the greater rental housing industry. If you have not taken this course—or if you not taken it in the law few years—please do yourself a favor and enroll the next time it is offered. The information that is presented is critically important in keeping rental housing providers, as well as their operational policies and practices, up to date with current Fair Housing laws. Thank you for all that you do, Denise! Next, a gigantic thank you is in order to Senator Tom Umberg (D-Santa Ana) and Assemblymember Bill Essayli (R-Corona) for co-sponsoring Senate Bill 71, which was signed into law by Governor Newsom on October 13, 2023. Senate Bill 71 increases the monetary jurisdictional limit in small claims court from $10,000 to $12,500, as well

as increases the limit from $25,000 to $35,000 in limited civil cases (unlawful detainers). This is a small, but not insignificant improvement for those of us in the rental-housing industry. Lastly, but of course not least, thank you, AAOC members, for your continued commitment and support. The opportunities and successes listed above would not be possible without you. Always striving to be a resource that you’re grateful for, AAOC will be working diligently through the end of 2023 and into the new year to continue delivering programs, services, and events that provide value to you and your fellow members, starting with numerous educational opportunities each month. New Crime-Free Housing & Micro Mobility Device Laws Taking Effect in 2024 Can local governments force an eviction of an entire family due to a felony conviction of a single family member? Can city and county governments require or even encourage rental property owners and managers from conducting criminal background checks during the rental screening process? And finally, can local governments impose penalties or require owners and agents to evict tenants based on calls to law enforcement, suspected activity, or other alleged nuisances? Effective January 1, 2024, the answer to those questions will be “no.” Assembly Member Tina McKinnor (D-Inglewood) successfully carried the measure that responds to these issues and one other issue. The new state law will not prohibit rental property owners and agents from conducting criminal background checks voluntarily or from terminating tenancies based on nuisance activity. housing policies have been an ongoing and very challenging matter and in the opinion of this author will be a continuing matter at issue. Governor Newsom also signed another bill which was authored by Senator Anthony Portantino (D-La Canada-Flintridge). This measure sets standards for the storage of e-bikes, e-scooters and other battery powered micro-mobility devices in rental housing. The bill, SB 712, allows tenants to store these devices indoors, but with some exceptions based on factors such as battery type, whether the tenant has insurance, and whether the owner/ agent can provide storage outside the dwelling unit. The new law takes effect on January 1, 2024, which recognizes the growing importance of micromobility devices while also addressing fires linked to faulty or incorrect battery types in a few e-bikes. For property owners, agents and tenants looking for specifics, e-bike batteries are to comply with either the UL 2849 standard that is recognized by the United States Consumer Product Safety Commission or the EN 15194 European Standards for electrically powered assisted cycles, E-scooters on the other hand, need to align with the UL 2272 standard from the US or the EN 17128 European Standard for personal light-electric vehicles. If a device’s battery fails to meet these standards, a tenant must maintain liability insurance if they store the device in the dwelling unit and the

owner and agent may prohibit the tenant from charging the device inside the dwelling unit. Senate Bill 712 gives owners and agents the option to provide tenants with exterior secure long-term storage for their devices. If storage is offered, owners and agents can prohibit the inunit storage of all these e-bike and e-scooters. The external storage of these mobility devices aim is to provide safety and accessibility for tenants. Tenants are permitted to perform minor maintenance tasks, including tire changes inside their dwelling units. Maintenance and modifications to motors can be prohibited or otherwise restricted by owners and agents. One of the most important factors however is for all the devices to adhere to fire codes including the standards set by the Office of the State Fire Marshal concerning lithium-ion battery safety. Your Buildings Have 12 Months Left to Live

Y

es, the headline seems hyperbolic, but consider this—on the November 2024 ballot we are going to see: • 5% cap on rent increases—eliminating the CPI exemption altogether. • 50% threshold to pass taxes and bonds. • Rent Control on Single Family Homes. • At least 12 other ballot initiatives. One year from now all three of these issues will crowd the ballot along with elections for: • President • US Senate • House of Representative Races • State, County, and local offices • County and local ballot initiatives • School Boards • Special Districts • America’s Got Talent Finalists • The Pepsi Challenge And, probably, some additional contests to decide that I have forgotten. In other words, this is going to be a very long election season, followed by a very long ballot, which leaves your properties with about 12 months to live if things go the wrong way.

The Ask

I am going to cut to the chase—protecting your properties from several of these initiatives is our main goal over the next 12 months—and it is going to be expensive. Defeating the Justice for Renters Initiative (AKA Weinstein 3.0) to limit rent increases to 5% and extend rent control to all residential property will cost a collective $90 million according to the California Business Round Table. $90 Million. For the next 12 months, contribute $1 per unit each month—and we will get there. AAOC members own and operate more than 100,000 rental units in Orange and Riverside Counties. $1 per unit per month amounts to $14 million of that $90 million if every rental property owner and operator participates. For the third and fourth largest counties in California by population, that should be our mission. We are asking you right here—right now—to commit to contributing $1 per unit, per month, to save your rental property and our industry.

The Landscape

Ballot initiatives, by nature, are long, confusing and at the whim of the voters. Looking ahead to 2024, we are expecting more of the same. So far, what we know is that ballot initiatives will be a heavy load—

• The Governor is pushing all ballot initiatives off the March 2024 primary ballot to the November general election ballot to garner more support for his mental health initiative. • The California Secretary of State reports there are: – 5 Initiatives Qualified – 7 Initiatives Eligible to be included (meaning they have qualified but supporters may push them to another—ideally less crowded—ballot in a later year) – 16 Initiatives are out for circulation. – 12 Initiatives are pending clearance from the Secretary of State to gather signatures. The November 2024 General Election ballot currently looks like it could have up to 40 ballot questions—and more may be coming— Watch — continued on page 10

The easy answer is to tell everyone to vote “No” on everything. Which would be good if we didn’t have some potentially great protections on this ballot: • The Taxpayer Protection Act would require an affirmative 2/3 vote in order to pass new taxes or bonds in the future. • An initiative to eliminate Michael Weinstein’s ability to bring rent control back for a fourth try. • Reforming the Private Attorneys General Act—and how shakedown lawsuits occur in California. This also highlights why it is so critical for us to get our messaging out to voters to reject rent control. What’s more, the city of Santa Ana has placed its rent control law on their local ballot for voter affirmation—and other cities may seek to do the same.

That $1 per unit, per month, can help fund all of these efforts—if you get on board—and bring your colleagues along with you.

The Potential

We have a real opportunity to make a statement on behalf of every housing provider in California, that: • Rent Control is not wanted here. • The AIDS Healthcare Foundation should stop funding political battles with the housing industry. • Taxes shouldn’t be placed on citizens without considerable support. The alternative is equally a powerful statement if you fail to get involved: • Your buildings are at the mercy of inflation.

• Your investments can and will be trampled on. • Your ability to provide quality housing is subject to the whim of the voters. It may seem hyperbolic, but it is the very real situation the rental housing industry is facing. Questions & Answers My husband and I are not “big time” landlords. In fact, we own a single fourplex in Costa Mesa. We just heard that a new law passed, limiting the security deposit amount to one months’ rent. Is that true? We often request two months’ rent as deposit when an applicant is close, but doesn’t quite meet our rental criteria, and seems like a reliable individual. Are we really prevented from taking two months’ security deposit now?

As with everything, there is more to the story. First, AB 12 was signed into law by Governor Newsom and goes into effect July 1, 2024. It does, in fact, limit the amount of security that can be collected by a landlord to one months’ rent (regardless of whether the apartment is furnished or unfurnished). However, the law contains an exception which allows landlords to continue to collect up to two months’ rent as a security deposit, provided the landlord is a natural person or a limited liability corporation in which all members are natural persons and, the owner owns no more than two (2) residential rental properties that collectively include no more than four (4) dwelling units offered for rent. In other words, because you own only a single, four-unit building, you are still allowed to collect up to two months’ rent as a security deposit. Of course, for other owners who own more than four units and are now limited to one months’ rent as security, there is nothing stopping them from requiring a guarantor as a condition of approval

I just heard the Federal government is working on a Tenants’ Bill of Rights. It’s bad enough we have to navigate “rent control” and “just cause” implemented by our state and city “leaders,” but now the Feds want to jump in on it as well? Is that true?

My brother and I own an ‘80s-built eightunit building in Huntington Beach. It’s covered by statewide rent control, the Tenant Protection Act. A friend of ours who also owns multi-family properties in the same area just told us that a new law passed, and we are no longer able to empty a unit to do remodeling work or to make major repairs. My timing has never really been good, and as luck would have it, I just served a 60-day termination notice a couple weeks ago to four units at the end of the building due to the condition they are in and the need to make some major repairs inside of them. Is my friend correct? Am I prevented from doing the work now? Do I have to cancel the 60 day notices I served?

In short, yes. Much like the state and local municipalities (who are likely taking their que from the Feds), the Federal government is developing a nationwide “Tenant Protections” agenda that will eventually begin rolling out. In 2023, the White House hosted a Zoom conference call with several prominent people, including Federal and state judges, the former Mayor of Chicago, and members of the Department of Treasury and the Department of Justice. Each individual spoke about the need to implement tenant protections, including mandatory mediation and diversion programs for tenants named as defendants in evictions. The Feds also published a document called a “Blueprint for a Renter’s Bill Of Rights” which contains the White House’s Five Principals for Renters, including: 1) access to safe, quality, accessible and affordable housing; 2) clear and fair leases; 3) education, enforcement, and enhancement of tenants’ rights; 4) the right to organize; and 5) eviction prevention, diversion, and relief. Every landlord should read that document to

Your friend is likely referring to SB 567 which modifies the “substantial remodel” provisions of the Tenant Protection Act, (aka, AB 1482, or the TPA). SB 567 put new limitations on landlords who want to do what is commonly referred to as a “substantial remodel.” Prior to the changes, a landlord could terminate a tenancy in a unit covered by the Tenant Protection Act to make substantial repairs (including abatement of hazardous materials such as lead based paint, mold, or asbestos) or demolish the property. While there were some requirements about what qualified for a “substantial remodel,” the process itself was easy and straight forward. To simplify


it, the termination notice had to have specific language, but otherwise, the landlord simply served a 60-day notice, and chose to either pay the tenant relocation fees (one month’s rent) within 15 days of serving the notice or waive the last month’s rent. However, several new amendments were made to the law which add to the requirements. Now, instead of simply serving a notice with the proper language included, the landlord must comply with several new requirements which include: 1) providing the tenant copies of all of the permits required to do the work with the termination notice; 2) specific language within the notice notifying the tenant that the landlord must offer the tenant the opportunity to reoccupy the unit pursuant to the same terms and rental rate as that which existed at the time the tenancy was terminated, in the event the landlord fails to do the work described in the notice, provided the tenant notifies the landlord of their

desire to do so within 30 days of the owner making the offer; and 3) a description of the work being done in the unit and the estimated duration of the project. More importantly, the amendments specifically state the tenant does not have to vacate the unit while work is going on unless remaining in the unit would be a violation of health, safety, or habitability laws. In your case, there is a bit of good news. Specifically, the law doesn’t go into effect until July 1, 2024, so your notices are fine and you can move forward with the remodeling project. I inherited a couple small properties after my dad recently passed away. My dad was from the “old country” and wasn’t as thorough as he should have been. When I went through the tenant files, I discovered that most of them have outdated information. From what I can gather, none of the information has been updated since the tenants

first moved in and, some moved in a long time ago! It seems likely that many of the tenants on the leases have moved out and been replaced by unknown roommates. Is there a way to clean this up and get the tenants to provide the information I need?

The good news is you inherited your dad’s properties. The bad news is you also inherited the mess that resulted from his “old school” methods. I’m glad to see you already understand the importance of maintaining and updating the information in the tenants’ files. Updating tenant information on a regular basis is a good business practice and, with a little bit of effort, can be done fairly easily. You can consider creating a simple document that asks the residents to provide the specific information you are looking for, such as the names of all residents in the apartment, their contact information (including Legal Q & A — continued on page 16

I just finished a rehab on my rental unit including painting, fixtures, wall plates, ceiling pot lights, etc. The place looks great, but it still looks unfinished, and I can’t put my finger on it. Any help with finishing touches? Bryan

Dear Bryan:

Caulk is your friend! If you look at the fixtures, wall plates, ceiling pot lights and anything else making contact with the walls and ceiling, you will notice a gap between the item and the wall. The gap is normally small and easy to miss, however, it does create a dark line where the item meets the drywall. We use the painter’s caulk that comes in squeeze tubes. The squeeze tubes are easy to handle and it’s best to cut a small diagonal opening at the end of the tube. Run a small bead of caulk along the fixture, wall plate, etc., and fill the gap until the dark line is hidden. Run your finger or a damp rag along the bead to remove any excess caulk.

This process works well where counter tops meet a wall and along base boards or coving. It even works if you have a large gap to fill. It will take the eye away from the dark gap.

I’m getting my work check off list started before winter comes. Do you have recommendations of what should be on the check list? Lisa

Dear Lisa:

After checking and repairing any roof damage, we recommend looking at the outside walls of the property. Stucco, wood siding or other vertical surfaces, is the building’s skin. Cracks, breaks and other damage to the siding invite “infection” to your building. This “infection” can take the form of wood rot, mold, siding delaminating or separation from the subsurface, and material breakdown of the stucco will cause discoloration and crumbling. Common siding material found in most buildings

is stucco, wood, brick, vinyl or concrete panels, etc. Water intrusion of the siding can find its way through the smallest of cracks by capillary action, or more directly from misaligned sprinklers or other water sources. A little known and often forgotten solution to leaky windows is the clogged weep holes along the bottom of the window frame and track. These weep holes clog with dust and debris and very easily can cause water to enter the building through the window frame or even through small cracks in the stucco or siding at the edges of the window frame.

Dear Maintenance Men:

What is an economical method of cleaning concrete driveways and sidewalks? The concrete has oil stains, chewing gum and organic matter stains. John

Dear John:

There are a few things you can do to help clean up the concrete. Oil stains can be spot treated with cat or absorbent litter. Spread the cat litter over the oil stains and grind the litter into the stains with your shoes. Leave it for 24 hours and sweep up after. Chewing gum can be removed by chilling the gum with ice or CO2 spray and using a putty knife to lift and scrape the gum off of the concrete. Use detergent and a stiff brush to remove the gum stain. Organic matter stains can be removed with power washer spray. If you have a large area of concrete to clean, use a power


washer. Set the power washer to 3,000 PSI and use the wide spray head. Be careful not to gouge the concrete with the spray; keep the hand wand moving. Softer material like brick will need less PSI or more distance between the spray head and the bricks.

We are getting close to the holidays, which means more people at your apartment buildings. Chances are, some of those residents will be inviting guests for dinner over the coming holidays. For some of these residents, this will be the first time this year they will turn on the oven! What are the odds you are just starting your own dinner, or you are sitting down with your own guests when an emergency call comes to you on Thanksgiving Day from one of your residents? That call might be about a clogged sink or nonworking oven with an apartment full of guests waiting for dinner. This scenario can ruin both you and your residents’ holiday. The answer is: Preventive Maintenance.

to not use the disposer as a trash can and then turn it on when full. It will clog. Christmas and other holidays also mean more people than usual walking on your property. Is your property safe? What are some of the liabilities to worry about? Check trip and fall hazards. Do you have sprinkler heads sticking up above the grass near sidewalks? Use pop-up heads to solve this problem. Look for sidewalks that have been pushed up by tree roots. This can

be solved with a concrete grinder or replacement of the section and removal of the tree root. Cut any low hanging tree branches and look for branches that may break in heavy winter wind or rain. Check your decking for cracks or damage and inspect the exterior stairways for wear and tear. Inspect all your garage door springs, winter wind and rain may make them heavy causing the door to close or fall unexpectedly. As a Maintenance Men — continued on page 16

Remember, the holiday season starts with Halloween and the demand on your properties only gets worse from there. Check each stove and oven for proper operation, many residents only turn on their ovens at this time of year, and the problem may be as simple as a pilot light being out. Also, check the oven’s temperature calibration with an oven thermometer. This time of year sees a higher than normal use of the plumbing, it may be a good idea to snake out or hydro jet your main plumbing lines. Also, sending a note to each tenant on the proper use of the garbage disposal will be useful. Note what they should and should not put down the disposal unit. A few items to include on this “No No” list are: banana peels; potato skins; coffee grounds; and any stringy food. Also, make sure they turn on the water before using the disposer and put down small amounts of food at a time. Instruct your residents November 2023

The Case for a Free-Market Approach to Rental Deposits

I

n the dynamic world of real estate, residential rental properties stand as a crucial investment avenue for many individuals. As housing providers, the welfare of our investments is paramount. Recent discussions about imposing limitations (California Assembly Bill 12) on rental deposits have sparked a debate within the rental housing industry. Advocates of such regulations argue for further government intervention through the imposition of tenantbiased measures, and it’s important to consider the perspective of property owners and the implications these reforms could have on our investments. In the financial realm, prudence is key, and it’s no different in real estate. Just as home buyers are required to make substantial down payments to secure their property purchase, expose their financial records in detail to demonstrate the ability and likelihood of fulfilling their obligations, and the bank holds title as a form of collateral, providing a safety net for their invest-

ment. Likewise, a rental deposit serves as a form of collateral for housing providers, offering some reassurance and compensation in case of damages or a breach of the lease agreement. Given the significant asset risk providers are taking, they should be free to determine a deposit that is adequate and that the market will bear. Limiting this deposit may jeopardize the housing provider’s ability to recover potential losses, placing their investment at risk. This is another example of lawmakers forcing constraints without taking any of the risks. I have yet to see a bill protecting housing providers by offering immediate compensation and free legal representation if a tenant damages a property beyond what can be covered by a deposit or unlawfully withholds rent but continues to use the owner’s asset. Property owners also should have the ability to safeguard their investment. The traditional practice of requiring a sizeable deposit from tenants is a logical and necessary step in mitigating risks

associated with renting out property. Consider that an aspiring homeowner who has good credit and wishes to purchase a $500,000 home is typically required to put down a minimum 10% down payment, equating to $50,000. This initial financial commitment is seen as a demonstration of financial capability and commitment to the purchase. In the same vein, housing providers who invest in rental properties should also have the right to set deposit amounts commensurate with the value of their investment and the risk involved. Government proposals advocating for a maximum one-month rental deposit seek to protect tenants and enhance affordability, but this is likely to undermine the level of security housing providers need to protect their investments. On the other hand, a freemarket approach would allow for negotiation between housing providers and residents, enabling both parties to agree on a deposit amount that is fair and


reflective of the property’s value, credit worthiness of the prospective tenant, and rental market dynamics. By forcing housing providers to charge a security deposit that is not commensurate with the risk, it hurts tenants and society, as a whole. We live in a nation often characterized by consumerism, where purchasing power is a cornerstone of modern living, and financial responsibility and savings often takes a back seat. Advocating for a culture of savings is an essential stride towards ensuring a stable and prosperous society. This is one of the intended benefits of Social Security—forced savings. One critical aspect of this financial prudence lies in encouraging individuals, regardless of their socioeconomic status, to save for security deposits when seeking rental housing. This fundamental shift not only cultivates better lifestyle habits but also aligns with the principles of responsible financial management. When prospective renters are required to save for security deposits, it instills a crucial financial habit early on. Much like the process of saving for a down payment when purchasing a property, saving for a security deposit reinforces the value of disciplined financial planning. It encourages individuals to budget, cut unnecessary expenses, and prioritize their spending. This practice teaches invaluable skills that extend beyond housing arrangements and positively impact various aspects of life. Moreover, incorporating this savings culture can have a ripple effect on the larger economic landscape. As individuals cultivate more fiscal responsibility, the overall demand for rental properties may stabilize. Prices and incomes can adjust accordingly, fostering a more balanced market. In turn, this is likely to contribute to a reduction in financial stress for both housing providers and tenants, leading to a healthier housing sector. Requiring a rental deposit commensurate with the value of the property and risk serves as a catalyst for fostering a heightened sense of pride, and appreciation

This financial stake instills a sense of responsibility, encouraging tenants to care for and maintain the property as if it were their own, ultimately establishing a mutually beneficial relationship between the tenant and the property owner, and even the community at large. Humans possess an inherent gift for creativity and adaptability, qualities that have driven our civilization’s progress throughout history. However, when government intervenes excessively and enacts laws that deviate from natural economic principles, it can stifle these innate abilities making people weak and dependent on government. Excessive and often short-sighted interventions diminish resilience, personal accountability and create an environment where people are less capable

of responding effectively to challenges and changes. Disallowing tenants from making their own fundamental financial decisions harms them and housing providers. Helicopter parents that do too much for their kids spoil them so that they don’t become self-reliant, and this is what government is doing by not allowing housing providers to run their own businesses. Life rewards those who have learned to save and manage money wisely. Encouraging a culture of saving for security deposits not only benefits individuals but also contributes to a more financially conscious society. By instilling this habit early on, we pave the way for a future where responsible financial decisions are the norm, enhancing the well-being and stability of all members of our community.

recently ran across the following question in a social media post: Question: Is there a way to know how safe your apartment building is in case of an earthquake? One person answered that if the apartment is still standing, it has survived everything until now—wrongly implying the building must be able to withstand a major earthquake because it has done so in the past. FTC Announces Proposed Rule on Junk Fees The proposed rule would target rental housing fees. Here’s what you need to know.

T

he Federal Trade Commission (FTC) today announced a notice of proposed rulemaking which would prohibit “hidden and falsely advertised fees” and require allin pricing across industries, including rental housing. The announcement comes as part of President Biden’s ongoing efforts to crack down on junk fees and bring down costs for consumers, closely aligning with his administration’s work on the Blueprint for a Renters Bill of Rights. The National Apartment Association (NAA) has always encouraged transparency throughout the leasing process and tenancy. The federal government’s proposed actions interfere with legallybinding lease contracts and ignore realities of operating rental housing. The proposed rule oversimplifies the advertising and leasing process; all fees, including contingent, optional and

usage-based fees, cannot be predicted with certainty at the time of application. If implemented, the proposed rule would: • Prohibit “hidden fees”—covered businesses that offer goods and services to consumers would be prohibited from advertising prices that hide or leave out mandatory fees; and • Prohibit “misleading fees”—covered businesses would be prohibited from misrepresenting fees and be required to disclose upfront the amount and purpose of the fees and whether they are refundable. The proposed rule would also require all businesses to quote total prices at the start of the purchasing process, remove false or misleading information about fees from the marketplace, and allow the FTC to secure refunds for

harmed consumers and seek monetary penalties against businesses that do not comply with its provisions. Today’s announcement is the continuation of the federal government’s rulemaking process. The FTC received 12,000 comments during its advanced notice of proposed rulemaking. Comments will be due 60-days from publication in the federal register. NAA will keep members and affiliate partners apprised of updates. EPA Proposes Unprecedented Lead Hazard Standards

Rental properties could be deemed a hazard with an almost zero lead level.

O

n August 1, 2023, the Environment Protection Agency (EPA) published a proposed rule that would dramatically alter the way lead dust hazards are classified. The agency has proposed that any detectable amount of lead dust be considered a hazard and that the threshold for clearance post-abatement be reduced. For covered properties and any entity that engages in remediation or abatement activities, this proposal would set a moving target that makes lead-dust cleanup—by definition— nearly impossible.

Background

The EPA began setting dust-lead hazard standards (DLHS) and dustlead clearance levels (DLCL) in 2001 under the Toxic Substances Control Act. The DLHS are used to determine

what amount of lead dust poses a health risk in housing units that participate in a federal assistance program and was built before 1978, the year lead-based paint was banned by the federal government. The DLCL, meanwhile, sets the acceptable amount of lead dust after an abatement is performed. Since these regulations have existed, the DLHS and DLCL have been coupled. For example, the EPA’s current figures for both values are 10 micrograms per square foot (µg/ft2) of lead for floors and 100 µg/ft2 for windowsills. Any lead dust above those numbers is considered a health hazard and any post-abatement cleaning will be considered successful if it brings the dust levels below those figures.

The new standards decouple the November 2023

DLHS and DLCL for the first time and present a non-numeric DLHS value of “any reportable level as analyzed by a laboratory recognized by EPA’s National Lead Laboratory Accreditation Program,” while the DLCL would be lowered to 3 µg/ft2 for floors, 20 µg/ft2 for windowsills, and 25 µg/ft2 for window troughs (down from 400 µg/ft2). This means that a property could be under DLCL but above the DLHS, triggering notification requirements even after abatement has been performed. In other words, a property that has effectively undergone a lead-dust abatement could very likely still be considered a hazard.

Maryland County Announces Sweeping Rent Control Bill

Howard County follows Montgomery County down a dangerous path.

O

n October 18, 2023, Howard County, Md. Executive Dr. Calvin Ball announced that rent control legislation will be introduced in the county, which would cap rent increases at 5 percent annually plus CPI with a maximum cap of 10 percent. While details are currently limited to information disseminated at Executive Ball’s press conference, rental housing providers in the county can expect elements of the newly formed Howard County Rent Stabilization Coalition’s proposal to be considered, which calls for: • “A cap of 3% or the CPI increase (whichever is lower) on rent increases in a single year; • No exemptions for any tenants or landlords or lease types;

• No exemptions for newlyconstructed rental units; • Vacancy Control, which would apply the rent increase limit from one tenant to the next; • Enforcement by the Howard County Department of Inspections, Licensing and Permitting and • Limits on administrative, miscellaneous and other fees, which can serve as an end run for landlords to get around the rent increase caps.” These proposals come on the heels of rent control laws in Mt. Rainier, Prince George’s County and Montgomery County, Md., and represent the increased interest in this flawed policy amongst lawmakers across the state and throughout the country. (NAA) has tracked 192 state bills related to rent control nationwide. The Maryland Multi-Housing Association (MMHA) continues to spearhead the industry’s advocacy efforts in Howard County and ensure the housing provider perspective is heard. “While we still haven’t seen a draft bill, MMHA intends to oppose any form of rent control that unreasonably caps rent,” said Aaron Greenfield, Director of Government Affairs for MMHA. “Rent control is a failed policy that exacerbates the affordable housing crisis that we see in Howard County and Maryland.” Recent research from NAA has found that 71% of housing providers have or expect to reduce investment and development in rent-controlled Rent Control — continued on page 38

Chronicles of an Executor

Navigating the Turbulent Skies of Estate Administration; The Dangers of Neglecting the Interpersonal

W

ith the passing of my father, William (Bill) Gorman, in May of this year, I started chronicling my journey through the executorship of his estate and, more recently, sharing my insights with the readers of Apartment News Magazine. This is the third article of the series. In the first article, published in September 2023, I discussed the preparations made and the complexities found while assuming the executor role. Despite the careful planning and expert advice received, along with the months and years spent establishing the family trust, there were still unexpected challenges. The second column, “Suspended in Free-Fall” (Apartment News Magazine, October 2023), focused on the initial steps taken and the prerequisite 120day hold before distributing the assets. As mandated, this waiting period allows for inquiries regarding unforeseen tax liabilities or reviews, audits, monies owed, and other concerns—any or all of these issues can potentially stretch the executorship process into a multi-year undertaking. Having spent so many years in financial management, I initially placed greater emphasis on the technical and business side of asset planning. Trusts, operating entities, tax strategies, and all the intricate details that facilitate the transition of wealth were my primary considerations. However, I ignored the interpersonal and family dynamics that I assumed would naturally fall into place. My neglect of those softer skills

soon became strikingly evident on both a personal and business level. As mentioned in my second article, one key advisor missing from the team was a trained facilitator to help address interpersonal issues and preferences. Substantial complexities arise from differences in blended families, cultural backgrounds, generational gaps, faiths, socio-economic statuses, and political affiliations. Professional guidance to foster open, respectful communications can make a world of difference in preserving family harmony during the estate administration process. Engaging in candid conversations with our loved ones about their preferences, plans, and wishes should be a proactive practice, occurring well before the need arises. Such discussions help to ensure clarity and enhance understanding, as well as act as a buffer against the turbulence of emotion that can obscure sound decision-making during stressful times. I also now recognize that other family members likely share the same emotions that I am experiencing. Keeping everyone in the communications loop is not only a stewardship obligation, it also serves as a simple, yet profound, act of kindness that should be extended to every family member. Then, of course, there are the questions that often remain unasked until it is too late. In hindsight, I wish I had probed my father for seemingly insignificant yet deeply personal details about his preferences—his favorite

restaurant, music, or even the setting he envisioned for celebrating his life. These seemingly minor inquiries can reveal surprising facets of a loved one’s personality, and the absence of such knowledge can sometimes lead to unexpected dilemmas. For instance, I recently discovered that the last CD my father had played in his car was disco. As a result, I now ponder whether Donna Summer should grace the playlist at his memorial. It is a poignant reminder of how these seemingly minor details can become meaningful touchstones when we seek to honor the memory of those we have lost. Throughout the rest of this holding pattern, I plan to share more lessons learned, including the distinction between drafting and implementing an estate plan versus creating and fulfilling a legacy. In my next article, I will delve into the process of selecting an executor and understanding the critical qualities that can make this role a linchpin in your estate plan. My chronicle as an executor marches onward, each step revealing new insights. It is a path marked by profound experiences, unexpected challenges, and valuable lessons.
