recall Governor Gavin Newsom, which is gaining steam in the wake of his handling of the COVID-19 pandemic. As of the meeting, approximately 1.1 million California voters had signed the recall petition, with 1.5 million valid signatures needed to qualify the recall for the ballot.

On the national front, Duringer touched upon the new Biden Administration and expressed his belief that the federal government will seek to exercise more regulatory control, with a push for increased affordable housing, which will affect Orange County and will ultimately result in inflated housing prices.

Duringer then discussed the passage of Proposition 19 and the impact it will have on the Parent-to-Child Exemption on property transfers and property tax reassessments in California. He urged members to exercise caution and to seek legal counsel as they evaluate their options and decide whether to make changes to their estate plans.

On the COVID-related legal front, Duringer pointed out that only five-tosix percent of renters are not paying their rent due to COVID, and that the vast majority have been diligent about fulfilling their rent obligations. Regarding pre-COVID eviction proceedings and other legal matters, he mentioned that the Orange County courts are open, with limited hours and limited in-person proceedings, and that many hearings are being conducted remotely via video.

Duringer concluded his remarks with guidance on how best to handle situations given the ongoing COVIDreality, stressing the need for good communication with tenants, working with them hand-in-hand, and keenly negotiating payment schedules, guidelines, etc. Regarding new tenancies, he recommended requiring pre-payment of rent for three months. He also emphasized the importance of being active in the management of your properties, advising that you, “…don’t just drive by, but go inside, take pictures and keep careful logs.” He also recommended, if possible, diversifying your real property holdings and not locking everything up in the state of California.

Duringer’s parting statement was a reminder to members to stay active in the community and to remain active and supportive of the Apartment Association of Orange County.
