PRESIDENT’S MESSAGE

It’s Showtime!

A

t long last, trade show month has finally arrived for the Apartment Association of Orange County (AAOC), and I couldn’t be more excited. It’s been a year-and-ahalf since we were forced to postpone (and eventually cancel) our 2020 show, but now we’re just days away from presenting our 50th Annual AAOC Trade Show & Conference on Thursday, September 30th, from 8:30 a.m. to 3 p.m., at the OC Fair & Event Center. I hope you will join me, in-person, for what will be a day of celebration and reconnection for our dynamic rentalhousing industry. As AAOC president and as an owner of rental property, I’m thrilled at the prospect of rental property owners, operators, managers, leasing agents, maintenance technicians, and other multifamily industry professionals coming back together for a day of educational seminars, networking, and introductions to new products and services aimed at helping them in the successful operation of their business and doing their job to the best of their ability. The AAOC Trade Show & Conference truly is one of the best industry trade shows in our state. As an industry supplier and trade show exhibitor, I can’t wait to once again be able to meet face-to-face with an exhibition hall filled with rental property owners of all sizes — from “mom and pop” apartment owners of a few units or buildings to the mid-sized and large institutional owners with

properties and thousands of units spread across multiple cities and counties. All potential business is welcomed, and I know the AAOC Trade Show & Conference is going to provide my company with opportunities, all day long, to meet with individuals and decision makers who are looking to expand their qualified vendor list and establish new business relationships. Of course, putting on a successful trade show requires a support network of committed individuals to step up and contribute in different ways toward a common goal. I want to take a moment to thank and acknowledge the key players who played critical roles making this year’s show happen. I want to start by thanking the AAOC board of directors for the wise counsel and leadership you’ve provided over the past 18 months as we have pivoted — multiple times — trying to make the trade show happen as soon as was reasonably possible. To our AAOC staff, thank you for your determination, perseverance, patience, hard work, and commitment as you have planned and prepared what I know will be a first-class trade show for our members and prospective members to enjoy and benefit from attending. EXECUTIVE DIRECTOR’S MESSAGE B y D avid J. C ordero E xecutive D irector

Remembering Malcolm Bennett

T

he rental housing and real estate industries lost a longtime leader, advocate, and a trail blazer, when Malcom Bennett passed away unexpectedly on July 21, 2021. For the Apartment Association of Orange County, we lost an ally and friend. Malcom served in many leadership capacities during his career as a real estate broker, contractor, and rentalproperty owner. In addition to forming and operating his own real estate firm, International Realty & Investments, which provided management, sales and acquisitions of income-producing properties, Malcom also dedicated significant amounts of time in service to the National Apartment Association, California Rental Housing Association, National Association of Realtors and California Association of Realtors. He was also an active member locally of the Apartment Association of California Southern Cities and the Los Angeles Association of Realtors, for which he served terms as president for both associations. In 1987, Malcom helped found the Minority Apartment Owners Association (MAOA) to assist minority property owners and help protect their interests as businesspeople and rental-housing providers in Los Angeles and later throughout California. His years of service and volunteerism to the real estate industry was recognized in 2014 when the Black Business Association honored him with the association’s Lifetime Achievement Award.

Malcom was also involved in the property management operations for the large portfolio of apartments owned by Los Angeles’ historically Black churches, in addition to serving on the Board of Directors for the SouthCentral Regional Center for the Disabled and two terms as president for the Crippled Children Society. I had the opportunity and privilege to work with Malcom on state rentalhousing issues and advocacy efforts more than 20 years ago, during my first tour of duty with AAOC. At the time, AAOC was working with the Apartment Association of California Southern Cities (AACSC) and the Apartment Association of Greater Los Angeles (AAGLA) to organize and launch a statewide advocacy coalition of independent apartment associations — a precursor to today’s California Rental Housing Association (CalRHA). My first impression of Malcom was that he was incredibly knowledgeable, insightful, and politically well-connected and astute. More significantly, however, I was struck by how warm he was as a human being and how generous he was with his time. As a young kid, recently graduated from college and just getting started in his career, I appreciated how Malcom treated me so kindly and how he embraced me as a colleague despite my youth and limited political and professional experience at the time. His personal encouragement and the time he made to personally engage with me when our paths crossed

at our coalition meetings and legislative advocacy trips in Sacramento meant a great deal. I truly liked and respected Malcom, and I appreciated all that he did for our industry and for the betterment of humanity. I will always remember him fondly. My thoughts and prayers are with his loved ones, friends, colleagues, and those whose lives Malcom touched during his lifetime. Rest in Peace, Malcom.

Update and Commentary on Changes to California’s COVID-19 Eviction Moratorium and Federal Rental Assistance Program

C

an you imagine waiting for two years or longer to initiate an eviction case based on nonpayment of rent if the rental property owner has attempted to obtain rental assistance to cover the unpaid amount and either: 1. The application for assistance has been denied by the “appropriate” governmental body; or 2. After 20 days pass, there is “no sign” that the tenant is going to cooperate? The court, before ordering an eviction for non-payment of rent to “verify that the landlord attempted to obtain rental assistance for the unpaid amount and that the application was denied due to one of the following: 1. The tenant was not eligible for rental assistance (the tenant earned too much during the period) 2. The government assistance program did not have sufficient funds

3. The tenant did not “cooperate with the landlord’s efforts” 4. The assistance does not apply to tenant households that move-in after September 30, 2021. For the first federal assistance trounce of money, state and local governments must distribute funds on or before September 30, 2022. And for the second federal trounce of money, state and local governments must distribute funds on or before September 30, 2024! No, this is not a typo. So, the legislature must think that the state and local programs may outlast our state of emergency and that rental property owners can wait several years to be paid rent.

Legislative Update: AB 1487 (Gabriel) Tenant Legal Aid

We expect Mr. Gabriel’s bill to be approved by the legislature and sent to the governor for his signature by the end of the state legislative session. The

measure establishes the framework for a grant-based program to provide direct legal aid services, education and outreach to low-income tenant households facing the threat of eviction or imminent displacement from their homes. Existing law is supposed to provide a fast-tracked set of summary judicial proceeding for handling eviction cases. The law also requires until January 1, 2030, statewide just cause to terminate a tenancy that meets specified conditions. State law also provides strong eviction protections due to the enactment of the COVID-19 Tenant Relief Act. The state also establishes several defenses to unlawful detainer complaints. While AB 1487 makes a series of findings and declarations about the state’s housing and homelessness crisis (as if property owners caused the crisis), the impact of the COVID-19 pandemic on that crisis and the track records of legal aid programs in preventing evictions, the measure does not appear to balance the interests of owners and tenants. The bill establishes the Homelessness Prevention Fund which will be administered by the Legal Services Trust Fund Commission under the State Bar of California and funded upon appropriation by the Legislature. The Homelessness Prevention Funds that will provide full legal assistance to low-income tenants is designed to prevent eviction. To accomplish this mission, a full-scope legal representation will be provided to qualified households facing eviction. To some degree, the Fund will pro-


vide education regarding tenant rights, fair housing laws, landlord obligations, and a multitude of other factors all designed to avoid eviction. This aspect of the program will target certain buildings and neighborhoods where tenants reside. The Fund will award money to entities that have a track record of successfully “delivering similar services to low-income renters and vulnerable populations.” These entities will focus on community-based organizations, nonprofit organizations, law schools and local government agencies. The program will be in addition to state and local government programs that currently provide millions of dollars of legal aid for similar purposes. The Legislature tested this proposition when it launched the Sargent Shriver Civil Gideon Project in 2011. The Legislature specifically designed the Shriver Project as a set of pilots intended to test the theory behind Civil Gideon: “whether the provision of legal counsel in life-critical civil matters would improve outcomes for lowincome litigants and whether or not such legal representation might also achieve certain efficiencies for the courts.” Data collection and evaluation requirements formed an integral part of the Project’s enacting legislation, which did not include a balanced analysis by the state Judicial Council or by a contracted outside firm, NPC Research. Stay tuned for more insight and information once this bill is signed into law and begin to be implemented. A Booming Political September in a “Non-Election”Year

U

sually, the waning days of summer in non-election years mean back-to-school sales, Labor Day picnics, and the end of our state’s legislative session where the members of the State Senate and State Assembly pack as many fundraisers as they can into five square blocks of downtown Sacramento. The end of the legislative session is the last opportunity for lobbyists, activists, and supporters to pay $1,500 for some personal

“face time,” in a semi-casual atmosphere, to chat with the officials as they try to pass, amend, or block legislation before the final day for each house to pass bills. Many legislators return to their districts at the end of each week in September for additional fundraisers and to engage with local supporters and activists who also want to have access to their state lawmakers. The AAOC Political Action Committee participates in many of these local fundraisers to keep the AAOC name and its issues at the forefront of our state and local elected officials’ minds. This September’s calendar is very different because of the Gubernatorial Recall Election: • Monday, September 6 is Labor Day, • Friday, September 10 is the last day to pass bills, • Saturday, September 11 is Patriot’s Day and the 20th anniversary of the terrorist attacks on U.S. soil • Tuesday, September 14 is the Gubernatorial Recall Election

Just the fact that the recall election exists changes the political dynamics entirely. The entire month of September will be packed with constant campaigning and fundraising with many legislators seeing their precious bills amended or blocked by a governor who does not want to do anything unpopular before Recall Election Day. And the continuing calls to reinstitute some of the

COVID-related restrictions are very unpopular with parents and businesses throughout the state. It is a unique time to be sure. The final day for the Governor to sign or veto bills passed by the Legislature is October 10. Here in Orange County, we have seen an unusual number of cities needing to fill vacancies on their city councils due to unexpected resignations. The cities of Anaheim, Cypress, Huntington Beach, and Orange have all had to decide whether to appoint a person to fill the vacancy or spend taxpayers’ dollars on holding special elections. Both options always present risks of being an unpopular choice for the sitting city council members who ultimately decide which option to take to fill the vacancy. The AAOC Legislative Committee has been keeping a close eye on all this activity, in what has certainly proven to be an extremely active political year, and we will continue to do so as we start preparing for the 2022 election cycle.

We have found that there are no two doors hung alike. They are all unique to their doorways. Let’s start with our husband’s plan. When you buy a slab door, it does not have a hole for the doorknob or latch, and it also does not have the hinges attached. It might take

a master carpenter to fit the door perfectly. The door frame might not be square, which means you will need to trim the door to fit the opening. You will find getting the hinges to line up with the existing hinges on the jamb is not an easy feat. You also need a special tool to drill the doorknob hole and latch. It might take you a few doors to get it right, but that might negate the savings of buying a slab door. Now, Maurine, your plan is to buy a pre-hung door. As you might guess, we recommend buying a pre-hung door. For those who don’t know what a prehung door is, let us explain. The prehung door comes as a complete door, including jambs, trim, hinges, doorknob & latch holes etc. The pre-hung door comes as a package with the jambs already square to the door. A pre-hung door can be installed by a novice easily the first time and is much faster than trying to wrestle with a slab door. After removing the old door jamb and trim and exposing the rough opening, insert the pre-hung door into the rough opening. Using a level, plumb and level the hinge side of the jamb using shims and gently nail the hinge side of the jamb in place. Level the top of the jamb using shims and nail into place. Using shims on the doorknob side of the jamb, be sure the door opens freely and closes without binding and nail the jamb in place. Most pre-hung doors come with the trim in place. Prioritize and bundle is the short answer. To elaborate, you will want to prioritize

all your non-emergency maintenance work by unit, building, and area, and then bundle enough work for each unit, building, or area to use your maintenance tech or vendor efficiently. The less your tech or vendor needs to travel between jobs the lower the cost of each job will be. Essentially, you would accumulate all non-emergency routine maintenance work placed on a P.O. or work order and forward it to your vendor or tech as authorized. This dramatically reduces the costs related to gas, trip charges, mobilization, purchase hours, etc. (It works even better if your parts are already onsite) Establishing a “time and material” (not to exceed) approach to billing vs. a perunit price method would also give you more bang for your buck. Orange County Lawmakers Call for Stricter Oversight of Older Buildings

S

hould older structures be inspected for safety?

It’s a question being raised throughout the nation as building officials, elected officials and residents weigh similarities between high-rises in their cities and the ill-fated Champlain Towers, which collapsed and killed nearly 100 people on June 24. The 12-story Florida condo tower was due for a 40-year inspection, required in Miami-Dade County. Here in California — the heart of earthquake country — there is no law requiring routine inspections of the structural integrity of existing buildings based on their age. Some local lawmakers are thinking that should change. “The Surfside building collapse was an incredible tragedy, one which must never happen again,” Sen. Dave Min (D-Irvine) told the Orange County Register. “As a representative of coastal communities in Orange County, I’m deeply concerned about the structural integrity of our beachfront properties. It is a failure of public policy that California does not require statewide review of aging buildings, as this would be an important tool to make determinations on resources and funding to help residents, buildings owners and local jurisdictions.” Sen. Tom Umberg (D-Santa Ana) agreed. “These tragedies make us wonder whether something like (Surfside) can happen in California, and what we can do to prevent it,” he told the Register. “With older buildings, there are several

levels of concern: first the building codes. At the outset, when the building was approved for occupancy, did we have adequate structural requirements to make sure that the building is safe and habitable for the foreseeable future? And second, do we require some sort of regular inspections?” Umberg noted, with irony, that laws have long been in place to conduct regular inspections of elevators and fire codes. “Is there a gap?” he asked.

Explosive earthquakes can strike California’s major metropolitan areas many times in a lifetime. From these experiences, we know the types of buildings will fall when that happens, and more importantly, why. • Imagine an apartment building built on stilts, with carports on the ground floor and residential units above. Seismic shocks can cause these buildings to rock violently and in many cases they eventually snap, with tragic results, as witnessed in the 1994 Northridge earthquake. • Nonductile concrete structures lack flexibility and can crumble and fall without proper fortification, leading to the collapse of freeway overpasses, parking structures and office towers. • Tilt-up buildings can separate where the walls meet the roof and fall in or out on the many people who frequent these warehouse-style commercial and office spaces daily.

I’ve written many times about the types of buildings proven to be vulnerable to deadly collapse in an earthquake. We know our vulnerabilities and how to fix them. But too many ignore those realities. Others mistakenly rationalize with themselves with the old mantra: I didn’t have damage before, so I won’t have damage when the next one strikes. “You’re asking people to think about things that they don’t like to think about,” said Patrick Otellini, who was chief resilience officer for San Francisco in 2013, when the city passed the first large city retrofit ordinance in the nation. Did You Know That You May Need a License to Play TV & Music in Your Rental Community?

M

any residential rental properties have a variety of audiovisual amenities in common areas, adding the comforts of TV and music to the lounge or the fitness center, for example. Large screen TVs, Bluetooth connected speakers and the like can be found in game rooms, clubhouses and even luxury screening rooms. But did you know that in order to be in compliance with U.S. Copyright Law, these properties

probably need licenses in support of these amenities? If you provide music or television in common areas like a lobby, lounge, clubhouse, game room or fitness center, you may be required to obtain a license. This is governed by the U.S. Copyright Act of 1976, Title 17, which considers common areas to be “public.” The licensing requirement applies whether you are showing DVDs, streaming, using a cable or satellite service, or even

just playing the radio. And it applies for scheduled “movie nights” as well as incidental unscheduled viewing or listening. A sports bar and kitchen in another case was sued for $1,050,000 for the playing of seven songs over the course of one night because its managers had ignored the attempts of performance rights organizations to provide the business with a public performance license. MPLC (Motion Picture Licensing Corporation) works on behalf of more than 1,000 producers, including the Hollywood studios, and is the only provider of blanket licensing for movies and TV in the United States. A blanket license covering TV and movies from MPLC is sold on an annual basis with no reporting requirements and is rela-

tively inexpensive to obtain. MPLC’s Umbrella License is similar to licenses for the public performance of music, issued by companies like BMI, ASCAP and SESAC. All of these companies share royalties with the creative community, helping to fund the production of new entertainment, which provides significant employment. An alternative movie license option is called a “title-by-title” license, typically offered by Swank Motion Pictures. Unlike MPLC’s Umbrella License, a title-by-title license is limited to one specific title. However, it enables the licensee to publicly advertise a movie and to charge admission (like a movie theater), which is not allowed under an Umbrella License. Three Ideas for Bringing TikTok into Your Social Media Marketing Mix

“Weapon” might sound a little medieval for multifamily, but when you look at the power of TikTok and the impact it can have on lead generation, it feels like an appropriate descriptor. Before we jump in, if your target renter is above the age of 40, then you likely don’t need to worry about learning and using TikTok for your apartment marketing. Sixty percent of TikTok users are between the ages 16 and 24 and 26% are ages 25 through 44. So, if your target renter is a Gen Z or a Millennial on the younger side, then your apartment needs to be on TikTok (even more so if your direct competitors aren’t yet). The platform is video only, so it definitely takes some time and effort to make content for your apartment, but it’s well worth it. As the current most popular app, many young adults are using TikTok to find apartments. Plus, unlike Facebook, Twitter, and Instagram, TikTok users watch videos

with the sound ON. This means your message will actually be heard and you don’t only have to rely on visuals. Here are three ways to utilize TikTok for your apartment marketing:

1. Make original content in bulk. Publishing consistent original content seems much less daunting when you create it in bulk. Try to set aside a few hours one day each week to create multiple videos. The great thing about TikTok is it’s all about trends. There’s nothing wrong with starting out your TikTok journey by simply recreating videos that have been turned into trends. To start, simply create an account for your apartment and begin scrolling through videos to get ideas. Over time, the algorithm will learn what kind of content you’re looking for and then you won’t have to scroll for long. I recommend also following real estate and lifestyle accounts that catch your eye.

It’s likely a few use TikTok in their personal time and are familiar with the platform and what’s popular. Some may even jump at the opportunity to be creative and make TikTok videos for the


property (an offer you should definitely take them up on). 2. Do a resident takeover. A resident takeover is when you give a trusted resident the login to your property’s TikTok and allow them to create/post videos for a day or even a week! This is a great way to add personality and authenticity to your account. It’s likely you don’t know which residents use TikTok or their accounts. An easy way to initiate a resident takeover is to send out a simple email and/ or social post explaining the goal and offering some sort of prize such as a gift card or gift basket. If you really want to stir up interest and have the budget to do so, offering something like a percentage off the following month’s rent can really draw your residents in; you may even get multiple interested parties and you can do a different resident takeover each month. Make sure to confirm that the chosen resident has some knowledge of TikTok

and can put together a high-quality video. If you’re offering a high-value prize, it is more than understandable for you to ask them to submit a video example. 3. Sponsor an influencer. That being said, if your current paid media and other marketing efforts aren’t pulling in leads, you might want to put a few months into giving this strategy a shot! The difference between doing a resident takeover and sponsoring an influencer is direct creative control. Since this is just like a job, you can tell the influencer exactly what kind of videos you want them to make, what you want them to say, what you want them to do and so on. This won’t create the same “down-to-Earth” feel as a resident takeover but it will allow you to showcase your property in the best light possible. While it’d be incredible if you had a

TikTok user living at your apartment, it’s not necessary to engage in sponsorships. Once you find one that is local or close enough to drive, you can host them for a day or even for a few hours. The great thing about sponsorships is that they’re incredibly flexible and all based on what you and the influencer agree on.

However you decide to use TikTok, make sure that from your profile a user can easily access your apartment website and book a tour. As fun and creative as TikTok is, the main goal is to drive leads. That said, never underestimate how many new leads a silly, funny video of a cat watching chicken spin around in the microwave can generate for your property.
